This AI Assessment Disclaimer ("Disclaimer") applies to the AI Readiness Audit Web App, Premium Report, Premium Report Dashboard, and any other tools, frameworks, or outputs (collectively, the "Services") provided by Christina Fischer / Human Pattern Works ("we," "us," or "our").

1. Informational Purpose Only
The Services, including the maturity ratings, risk assessments, recommendations, and benchmarking data, are provided for informational and educational purposes only. They are not intended to constitute:

• Professional, legal, financial, or technical advice;
• A substitute for consultation with qualified professionals;
• A guarantee of compliance with any laws, regulations, or industry standards (including but not limited to the Swiss Federal Act on Data Protection (FADP) or EU AI Act).

You are solely responsible for evaluating the accuracy, completeness, and usefulness of the Services and for verifying all findings before making any business decisions based on them.

2. Probabilistic Nature of AI and Hard-Coded Logic

• The maturity rating system is based on a deterministic, hard-coded scoring algorithm (not generative AI). While this ensures consistency, it may not capture all nuances of your organization’s unique context.
• The recommendations and insights are derived from predefined logic and industry benchmarks. They are not personalized professional advice and may not account for all variables relevant to your specific situation.
• No warranty is provided regarding the accuracy, reliability, or suitability of the Services for your intended use.

3. Human-in-the-Loop (HITL) and Liability

• For high-risk or complex assessments (e.g., regulated industries like Finance, Healthcare, or Government), we implement a Human-in-the-Loop (HITL) review to ensure accuracy. However, this does not constitute a full audit or legal opinion.
• Our liability is strictly limited to the terms outlined in our General Terms and Conditions and Service Agreements. Under Swiss law, we cannot exclude liability for gross negligence or willful misconduct, but we disclaim all liability for slight or ordinary negligence to the fullest extent permitted by law.
• You agree to indemnify and hold us harmless from any claims, damages, or losses arising from your use of the Services or reliance on their outputs.

4. Data and Privacy

• The Services collect organizational data (e.g., team size, industry, AI maturity responses) to generate ratings and recommendations. This data is processed in accordance with our Privacy Policy.
• No sensitive personal data (e.g., financial records, PII) is required to use the Services. If you voluntarily provide such data, you do so at your own risk.
• All data is stored on Swiss-based servers (Infomaniak) and is subject to the Swiss FADP and, where applicable, GDPR.

5. No Endorsement or Certification

• The maturity levels (Unmined, Raw Ore, Bronze, Silver, Gold) and any associated badges or certificates are not official certifications of compliance, performance, or legal standing. They are internal frameworks designed for self-assessment and improvement.
• Sharing results publicly (e.g., LinkedIn, marketing materials) does not imply our endorsement of your organization’s practices. You are responsible for ensuring any public claims comply with applicable laws.

6. Third-Party Tools and Integrations

• The Services may integrate with third-party tools (e.g., SurveyJS, Make, Stripe, Infomaniak SMTP). We are not responsible for the privacy practices, security, or reliability of these tools. Their use is governed by their respective terms and policies.
• Payment processing (e.g., for Premium Reports) is handled by Payhip/ Mollie and is subject to their terms.

7. Changes to the Services
We reserve the right to modify, suspend, or discontinue the Services at any time without notice. We will use reasonable efforts to notify you of material changes via email or our website.

8. Governing Law and Jurisdiction
This Disclaimer is governed by the laws of Switzerland. Any disputes arising from or related to the Services shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.
