By accessing or using Human Pattern Works ("we," "us," or "our") website (https://humanpattern.works) or any of our Services (defined below), you agree to comply with and be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use our Services.

1. Definition of Services
Our Services include:

  • Website: Informational content, blog, and contact forms.
  • AI Readiness Audit Web App: Self-service tool for assessing AI maturity (free tier).
  • Premium Report: One-time purchase (CHF 500) for a detailed PDF analysis.
  • Premium Report Dashboard: Subscription-based (CHF 350/month) interactive tool for tracking progress.
  • Certificates: Optional add-ons (e.g., "AI-Ready Certified" badges).


2. Acceptance of Terms
By using any of our Services, you represent that:

  • You are at least 18 years old or have legal capacity to enter into a binding agreement.
  • You have read, understood, and agree to these Terms, our Privacy Policy, and our AI Assessment Disclaimer.
  • You are using the Services only for lawful purposes and in compliance with all applicable laws (including Swiss FADP and EU AI Act where relevant).


3. User Obligations
You agree to:

  • Provide accurate, complete, and up-to-date information when using the Audit Web App or Premium Services.
  • Not use the Services to:
    • Violate any laws or regulations;
    • Submit false, misleading, or fraudulent data;
    • Reverse-engineer, scrape, or attempt to extract our proprietary frameworks (e.g., maturity scoring logic, question sets);
    • Interfere with or disrupt the Services (e.g., via bots, spam, or DoS attacks).
  • Not share your account credentials (for Premium Report Dashboard) with unauthorized users.


4. Intellectual Property Rights

  • Our Content: All content on our website and in our Services—including text, graphics, logos, the AI Readiness Audit framework, maturity levels (Unmined, Raw Ore, Bronze, Silver, Gold), scoring algorithms, and report templates—is the exclusive intellectual property of Human Pattern Works and is protected by Swiss and international copyright laws.
  • Permitted Use: You may:
    • Use the free Audit Web App for self-assessment.
    • Download and share your Premium Report or Certificate internally within your organization.
    • Display your maturity badge (e.g., "HPW AI-Ready: Silver") on your website or LinkedIn only if you have purchased the Certificate.
  • Prohibited Use: You may not:
    • Reproduce, distribute, or sell our maturity framework or report templates without our written consent.
    • Use our branding (e.g., HPW logo, maturity badges) in a way that implies our endorsement of your organization.
    • Claim that your use of our Services constitutes a formal certification or legal compliance with any regulation (e.g., FADP, EU AI Act).


5. Fees and Payments
Service Fee Terms:

  • Free Tier (Audit Web App) Free Limited to 1 maturity rating per email; includes basic results (no PDF).
  • Premium Report CHF 500 (one-time) - Detailed 5–7 page PDF; includes benchmarking data and actionable recommendations. 
  • Premium Report Dashboard CHF 350/month (per org) Interactive dashboard; quarterly re-audits; historical tracking.
  • Certificate CHF 1'500 (one-time) Official PDF + LinkedIn badge; included in "Custom Cosmos" package.
  • Learning Hub CHF 20/user/month Self-guided up-skilling; included in Packages 2–4 during mandate.

  • Payment Methods: Payhip/ Mollie (subject to their terms).
  • Refunds: No refunds for Premium Reports or Certificates after delivery. Dashboard subscriptions may be canceled anytime (no prorated refunds).
  • Taxes: Prices exclude VAT (if applicable). Swiss-based customers are subject to Swiss VAT.


6. Disclaimers and Limitation of Liability

  • Informational Use Only: The Services are provided "as is" and "as available" for informational purposes only. We do not warrant that the Services will:
    • Meet your specific requirements;
    • Be error-free, secure, or uninterrupted;
    • Provide accurate or complete results (e.g., maturity ratings, risk assessments).
  • No Professional Advice: The Services do not constitute legal, financial, or technical advice. You should consult a qualified professional for such advice.
  • Limitation of Liability:
    • Our total liability to you for any claims arising from these Terms or your use of the Services is limited to the greater of (a) CHF 1,000 or (b) the amount you paid us in the 12 months prior to the event giving rise to the claim.
    • We are not liable for:
      • Indirect, incidental, or consequential damages (e.g., lost profits, reputational harm);
      • Damages resulting from your misuse of the Services or violation of these Terms.
    • Gross negligence or willful misconduct is not excluded.


7. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or losses (including legal fees) arising from:

  • Your breach of these Terms;
  • Your use of the Services in violation of applicable laws;
  • Your reliance on the Services for critical business decisions without independent verification.


8. Termination

  • By You: You may stop using the Services at any time. For subscription services (e.g., Premium Report Dashboard), you may cancel via your account settings (effective at the end of the billing cycle).
  • By Us: We may suspend or terminate your access to the Services (or any part thereof) without notice if you:
    • Violate these Terms;
    • Engage in fraudulent or abusive behavior;
    • Fail to pay fees for Premium Services.
  • Effect of Termination: Upon termination, you will lose access to the Premium Report Dashboard and any stored data (unless required by law to retain).



9. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of Switzerland.
  • Any disputes shall be resolved in the courts of Zurich, Switzerland.
  • Mandatory Mediation: Before initiating litigation, parties agree to attempt mediation under the Swiss Chambers’ Arbitration Institution.



10. Miscellaneous

  • Assignment: You may not assign these Terms without our written consent. We may assign or transfer our rights to a successor entity.
  • Severability: If any provision of these Terms is found to be invalid, the remaining provisions will remain in effect.
  • Entire Agreement: These Terms (including the Privacy Policy and AI Assessment Disclaimer) constitute the entire agreement between you and us regarding the Services.
  • Force Majeure: We are not liable for failures caused by events beyond our control (e.g., natural disasters, strikes, internet outages).
